Welcome to the VGSpartans platform ("Platform"), operated at vgspartans.org and its subdomains. These Terms of Service ("Terms") govern your access to and use of the Platform. By accessing or using the Platform in any capacity — whether as a registered user or a public visitor — you agree to be bound by these Terms. If you do not agree, do not use the Platform.
These Terms are organized into three parts for clarity:
- Part I — General Terms apply to everyone who accesses the Platform in any capacity.
- Part II — Visitor Terms apply to public visitors who browse the Platform without an account.
- Part III — Registered User Terms apply to individuals who create and maintain an account.
If you are a registered user, all three parts apply to you. If you are a visitor, Parts I and II apply.
Part I — General Terms
These terms apply to all individuals who access the Platform, whether as a visitor or a registered user.
1. Definitions
Throughout these Terms, the following definitions apply:
- "Platform" refers to the VGSpartans website and all services accessible at vgspartans.org and its subdomains (including but not limited to sites.vgspartans.org, admin.vgspartans.org, advisor.vgspartans.org, manage.vgspartans.org, bounty.vgspartans.org, status.vgspartans.org, and all club subdomains such as keyclub.vgspartans.org).
- "School" refers to Vista Grande High School.
- "District" refers to the Casa Grande Union High School District.
- "Visitor" refers to any individual who accesses publicly available pages of the Platform without logging in.
- "Registered User" or "User" refers to any individual who has created an account on the Platform.
- "Content" refers to any text, images, files, code, media, or other materials uploaded, published, or transmitted through the Platform.
- "Platform Administrators" refers to the Platform developer, the School's IT department, and any other individuals authorized to manage the Platform.
- "We," "our," "us" refer to the Platform, its operators, the School, and the District collectively.
- "You," "your" refer to the individual accessing or using the Platform.
2. Platform Description
The VGSpartans platform is a campus-wide digital infrastructure operated for the School as part of the District. The Platform provides club websites, student and teacher personal sites, and related organizational tools. It is not a commercial service, is provided at no cost to users, and does not display advertising.
3. Intellectual Property
3.1 Platform Software
The Platform software, design, architecture, documentation, and all related intellectual property are owned by the Platform developer and are protected by copyright and other intellectual property laws. The Platform's source code is publicly available under the GNU Affero General Public License version 3 (AGPL-3.0). The School and District hold a perpetual, royalty-free, non-exclusive license to use the Platform software. You may use, modify, and distribute the Platform's source code in accordance with the terms of the AGPL-3.0 license. All other rights not expressly granted by the AGPL-3.0 are reserved by the Platform developer.
3.2 Trademarks
"VGSpartans" and associated branding are used with the authorization of the School. You may not use the Platform's name, logos, or branding in any manner that suggests endorsement by or affiliation with the Platform, the School, or the District without prior written authorization.
3.3 Public Content
Content published on publicly accessible pages of the Platform (including club websites and student personal sites) is displayed for informational purposes. Viewing this content does not grant you any license to reproduce, distribute, or create derivative works from it unless explicitly stated otherwise.
4. Third-Party Services
The Platform integrates with third-party services to provide its functionality. These include, but are not limited to, infrastructure and content delivery services (Cloudflare), email delivery services (Resend), logging and analytics services (Axiom), error tracking services (Sentry), version control platforms (GitHub, GitLab), uptime monitoring (UptimeRobot), status page hosting (Instatus), and video hosting (YouTube). Your use of the Platform constitutes acknowledgment that certain data may be transmitted to and processed by these third-party services in accordance with their respective terms of service and privacy policies. The Privacy Policy provides additional detail regarding third-party data sharing.
5. Prohibited Conduct — All Users
Whether you are a visitor or a registered user, you may not:
- Attempt to gain unauthorized access to any portion of the Platform, other accounts, computer systems, or networks connected to the Platform.
- Interfere with or disrupt the Platform, its servers, or networks connected to the Platform.
- Use automated scripts, bots, scrapers, or other automated means to access, index, or extract data from the Platform without prior written authorization from Platform Administrators. Authorized search engine crawlers verified via reverse DNS are exempt from this restriction.
- Bypass, circumvent, or attempt to bypass or circumvent any security measures, rate limits, bot detection, or access controls implemented on the Platform.
- Probe, scan, or test the vulnerability of the Platform or any associated system or network, except through the Platform's authorized bug bounty program.
- Use the Platform in any manner that violates applicable federal, state, or local laws or regulations.
6. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THE PLATFORM, THE SCHOOL, THE DISTRICT, AND THE PLATFORM DEVELOPER DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
THE PLATFORM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT WILL BE ACCURATE, RELIABLE, OR COMPLETE. YOU ACCESS AND USE THE PLATFORM AT YOUR OWN RISK.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PLATFORM, THE SCHOOL, THE DISTRICT, THE PLATFORM DEVELOPER, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF CONTENT, LOSS OF USE, OR LOSS OF PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF THE PLATFORM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE TOTAL LIABILITY OF THE PLATFORM, THE SCHOOL, THE DISTRICT, AND THE PLATFORM DEVELOPER FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED ONE DOLLAR ($1.00 USD).
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Pinal County, Arizona, and you consent to the personal jurisdiction of such courts.
9. Changes to These Terms
The Platform reserves the right to modify these Terms at any time. Material changes will be reflected in an updated "Last Updated" date at the top of this document. For registered users, material changes will also be communicated through the Platform (such as a banner on the dashboard or a notification upon login). Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.
10. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
11. Entire Agreement
These Terms, together with the Privacy Policy and any applicable School or District policies, constitute the entire agreement between you and the Platform regarding your use of the Platform and supersede all prior agreements and understandings.
Part II — Visitor Terms
These terms apply to public visitors who browse the Platform without a registered account. If you are a registered user, these terms also apply to you when you access public pages.
12. Scope of Visitor Access
As a visitor, you may browse publicly accessible pages of the Platform, including club websites, public student and teacher personal sites, the main portal, the bug bounty program information page, and the public status page. You do not need an account to access these pages.
13. Visitor Data Collection
When you visit publicly accessible pages of the Platform, certain technical data about your visit is automatically collected by the Platform's infrastructure provider (Cloudflare) and by the Platform itself. This data includes, but is not limited to, your IP address, approximate geographic location, browser type and version, operating system, referring URL, pages visited, and timestamps. This collection is described in detail in the Privacy Policy. By accessing the Platform, you consent to this data collection.
Public-page analytics are provided by Cloudflare Web Analytics, which operates without cookies and does not track individual visitors across sessions or across websites.
14. Visitor Form Submissions
Certain publicly accessible pages may include forms (such as club membership sign-up forms, event sign-up forms, contact forms, and bug bounty submission forms). By submitting a form, you consent to the collection and processing of the information you provide for the purposes described on the form. All public-facing forms are protected by Cloudflare Turnstile, a bot detection service, which may collect additional technical data to distinguish human visitors from automated bots.
15. Embedded Content
Certain pages may contain content embedded from third-party services, including YouTube videos. When you interact with embedded content (for example, by playing a video), the third-party provider may collect data about you in accordance with its own privacy policy. The Platform is not responsible for the data practices of third-party content providers.
16. Visitor Prohibited Conduct
In addition to the prohibited conduct described in Section 5, visitors may not:
- Attempt to access non-public areas of the Platform (including dashboards, consoles, or API endpoints) without valid credentials.
- Submit false, misleading, or malicious information through any public-facing form.
- Use information obtained from public pages to harass, stalk, or harm any individual associated with the Platform.
Part III — Registered User Terms
These terms apply to individuals who create and maintain a registered account on the Platform. Parts I and II also apply to registered users.
17. Eligibility
17.1 Who May Register
The Platform is available exclusively to individuals affiliated with the School, including current students, teachers, staff, club advisors, and designated administrators. Registration requires a valid school-domain email address (@cguhsd.org) or inclusion in an authorized access list maintained by Platform Administrators.
17.2 Age Requirements
The Platform is intended for use by individuals aged 13 and older. If you are under 13, you may not create an account or use the Platform. If you are under 18, your use of the Platform is subject to the policies of the School and District, and your parent or legal guardian is deemed to have consented to these Terms through the School's acceptable use policies.
18. Account Creation and Authentication
18.1 Account Verification
To create an account, you must verify your identity through a one-time code sent to your school email address. Upon successful verification, you will be issued login credentials appropriate to your role.
18.2 Credential Security
You are solely responsible for maintaining the confidentiality of your login credentials. You must not share your credentials with any other person. Any activity conducted under your account is your responsibility unless you report the account as compromised through the Platform's designated process.
18.3 One Account Per Person
Each eligible individual may hold one account per role. Creating multiple accounts, impersonating another user, or using another person's credentials is prohibited.
19. Acceptable Use — Registered Users
19.1 General Use
You agree to use the Platform only for lawful purposes consistent with the School's educational mission. You may use the Platform to create, host, and manage web content within the scope of features provided to your role.
19.2 Prohibited Conduct
In addition to the prohibited conduct described in Section 5, registered users may not:
- Upload, publish, or transmit any content that is unlawful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- Upload content that infringes any patent, trademark, copyright, trade secret, or other intellectual property right of any party.
- Upload or distribute malware, viruses, or any code designed to disrupt, damage, or limit the functionality of any software, hardware, or network.
- Use the Platform to distribute spam, chain letters, or unsolicited communications.
- Engage in bullying, harassment, intimidation, or discrimination against any individual.
- Post content that contains personal information of another individual without their consent.
- Attempt to circumvent resource limits, storage quotas, or rate limits assigned to your role.
- Use the Platform in any manner that violates the School's or District's acceptable use policies.
19.3 Content Standards
All content you upload, publish, or transmit through the Platform must comply with the School's and District's acceptable use policies. Content is subject to review through both automated and human moderation processes. The Platform reserves the right to remove, quarantine, or restrict access to any content that violates these Terms, applicable law, or School policy, with or without notice.
19.4 Resource Limits
Your use of Platform resources (storage, bandwidth, API calls) is subject to the limits and quotas established for your role. These limits may be adjusted by Platform Administrators at any time.
20. Your Content
20.1 Ownership
You retain ownership of the original content you create and upload to the Platform, subject to the licenses granted below. The Platform does not claim ownership of your content.
20.2 License to the Platform
By uploading content to the Platform, you grant the Platform, the School, and the District a non-exclusive, royalty-free, worldwide license to host, store, display, reproduce, modify (for formatting and technical purposes), cache, archive, and distribute your content solely in connection with operating, maintaining, improving, and securing the Platform. This license persists for the duration your content remains on the Platform and for a reasonable period thereafter to fulfill archival and compliance obligations.
20.3 Content Archival
Your content may be archived and retained by the Platform, the School, and the District in accordance with the Platform's data retention policies and applicable records retention requirements. Archived content may be stored on third-party infrastructure (including but not limited to GitHub repositories and cloud storage services) for backup, governance, and compliance purposes. You acknowledge that deletion of your account does not necessarily result in the immediate deletion of all archived copies of your content.
20.4 Club Content
Content published to club websites is managed by authorized club webmasters and advisors. Club content is owned by the respective club organization and the School. If you contribute content to a club site in your capacity as a webmaster or authorized contributor, you acknowledge that such content is subject to the editorial control of the club's advisor and Platform Administrators.
20.5 Content Moderation
The Platform employs automated content analysis tools powered by artificial intelligence, as well as human review processes, to evaluate content for compliance with these Terms and applicable policies. Content may be flagged, quarantined, or removed at any time. You will be notified when content moderation actions are taken against your content, where practicable.
21. Account Lifecycle
21.1 Student Accounts
Student accounts expire on the student's graduation date (May 22 of the graduation year, as determined by the student's school email identifier). Upon expiration, your account will be disabled, your site will be archived, and your content will be handled in accordance with the Platform's data retention policies.
21.2 Teacher and Staff Accounts
Teacher and staff accounts are valid for two years from creation and may be renewed through a dual-confirmation process involving both the account holder and a Platform Administrator. Accounts that are not renewed will expire and be handled in accordance with the Platform's data retention policies.
21.3 Mid-Year Departure
If you leave the School mid-year, your account may be disabled at any time by a Platform Administrator.
21.4 Account Suspension and Termination
The Platform reserves the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms, applicable law, or School policy. Upon termination, your access to the Platform and its features will cease. The Platform is not obligated to provide you with a copy of your content upon termination, although archived copies may be retained in accordance with data retention policies.
22. Security and Monitoring
22.1 No Expectation of Privacy from the Institution
You acknowledge and agree that your use of the Platform is subject to monitoring, logging, and review by Platform Administrators, the School's IT department, and the Platform developer. You have no expectation of privacy with respect to any content, communications, or activities conducted on or through the Platform from these parties. All platform activity — including but not limited to logins, file uploads, file deletions, content modifications, page visits, settings changes, and messages — is logged and may be reviewed at any time for security, compliance, governance, or investigative purposes.
22.2 Security Measures
The Platform implements security measures designed to protect the integrity of the Platform and the safety of its users. These measures include, but are not limited to, the collection and analysis of technical data about your device, network, and usage patterns, including device fingerprinting. You consent to the collection and use of this data as described in the Privacy Policy.
22.3 Reporting Compromised Accounts
If you believe your account has been compromised, you should report it immediately through the Platform's compromised account reporting process or by contacting a Platform Administrator in person. The Platform will take reasonable steps to secure your account and investigate the incident.
23. Indemnification
You agree to indemnify, defend, and hold harmless the Platform, the School, the District, the Platform developer, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any content you upload, publish, or transmit through the Platform; or (e) your violation of any third party's rights.
